What information is collected from you by responsemedia.com?
responsemedia.com collects information in a variety of ways:
  • Online Registration. responsemedia.com’s online registration forms may require users to give us contact information (i.e., name and email address) and demographic and shopping profile information (i.e., zip code, age, income level, and shopping preferences).

  • Online Survey. responsemedia.com may conduct online surveys from time to time during which online survey visitors are asked for contact information (i.e., email address) and demographic and shopping profile information (i.e., zip code, age, income level, and shopping preferences).

  • Contests. responsemedia.com may run contests on our site during which we ask visitors for contact information (i.e., name, address, and email address) and demographic information (i.e., zip code, age, or income level).

  • IP Addresses. responsemedia.com collects IP addresses and other info to help diagnose problems with our servers and for system administration.

  • Anonymous Information. responsemedia.com collects Anonymous Information which cannot be traced back to a specific individual and includes, without limitation, demographic information (including, but not limited to, age, gender, income level, and education level) and psychographic information (including, but not limited to, where you heard about responsemedia.com, and your current ISP configuration). Additionally, we automatically gather certain technical information about you based upon your use of the Service. This technical information may include the Uniform Resource Locator (“URL”) of the Site from which you just came, the URL to which you next go, what browser you are using, your Internet Protocol (“IP”) address, and certain operating metrics, such as the number of click-throughs a service receives. In addition to technical information, your IP address is a 12-digit number (address) which your ISP gives you each time you go on to the Internet. Each of your requests for a page or other information contains this IP address, so that the sites you are visiting know where to send the page. This technical information is compiled and analyzed on an aggregated basis, along with demographic and psychographic information which has been dissociated from your Personal Information (i.e., name, mailing address, email address, etc.). We use the Anonymous Information to research our users’ demographics, interests, and behavior in order to better understand and serve them. All of the above Anonymous Information is used only on an aggregated basis to help determine the most popular services and to provide advertisers with general user information.

  • Information that Response Media collects on a Client’s behalf, which may include, but is not limited to; name, email address, DOB or Mo/Yr. of birth, physical address and/or zip code, time/date stamps, IP address/device ID, child’s due date or mo./yr birth, number of children, custom survey info – such as shopping habits, purchase info, cookies, and/or device identity information that may be used to track and retarget individuals on behalf of clients.

  • Third-Party Technologies. responsemedia.com uses third-party technologies such as Apollo, HubSpot, and third-party media tracking pixels (e.g., Google and Facebook/Instagram) to collect and process data.

How will the information be used?

responsemedia.com uses the contact information to respond to your specific requests, to send you information about our company. The information is also used to tailor your experiences at our Site so that we display only that information which we have determined you are likely to find of interest. Anonymous Information may be used and disclosed at our discretion.

With whom will your information be shared, if anyone?

As a general rule, responsemedia.com will not disclose any of your Personal Information except when we have your permission or under special circumstances, such as when we believe in good faith that the law requires it.

The Site contains links to other websites which may collect personally identifiable information about you. responsemedia.com does not control the content or practices of any other site. responsemedia.com does not endorse or accept responsibility for the privacy breaches of such sites.

You can access, change or update any or all of your information by using the following services:

Follow instructions given to make changes to your information. responsemedia.com shall have a reasonable time to implement any requested change.

What is our opt-out policy?

Responsemedia.com provides users the opportunity to opt out from receiving emails at any time. Users should enter the email address in the unsubscribe form to remove that address from electronic promotions.

What measures do we take to protect children?
The safety and privacy rights of children are very important to us. responsemedia.com will:
  • NOT collect online contact information without prior parental consent or parental notification, which will include an opportunity for the parent to prevent use of the information and participation in the activity. Without prior parental consent, online information will only be used to respond directly to the child’s request and will not be used for other purposes;

  • NOT collect personally identifiable offline contact information without prior parental consent;

  • NOT distribute to third parties any personally identifiable information without prior parental consent;

  • IP Addresses. responsemedia.com collects IP addresses and other info to help diagnose problems with our servers and for system administration.

  • NOT give the ability to publicly post or otherwise distribute personally identifiable contact information without prior parental consent; and

  • NOT entice by the prospect of a special game, prize or other activity, to divulge more information than is needed to participate in the activity.

How do we use Cookies? Information Collected Automatically
responsemedia.com uses cookies to store and sometimes track information about you, measure the effectiveness of advertising and analyze site activity. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer.

  • Commercial information, including information about orders or purchases of any of our products or services; registration information, specials, and information you provide or submit to us when you participate in any event, program, contest, survey or other promotion that we may offer from time to time.

  • Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding your interaction with our websites, mobile apps, advertisements that we display on our websites or mobile apps or on third party sites and apps, or Response Media pages or accounts on any third-party social media platforms.

  • Geolocation data.

  • Audio information from calls placed with customer service and accounting centers which may be reported, and electronic information in the form of Internet or other electronic network activity information described above.

  • Inferences drawn from (1) the information we collect when you visit our websites, tools, widgets and plug-ins, (2) information we collect, including through third-party suppliers, regarding content and other data posted on the Internet (such as public locations on the Internet), and (3) information about consumers preference and behavior that we collect on our websites or purchase from third parties in order to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities and aptitudes.

    Your California Privacy Rights

    If you are a California resident, you have the following rights. We will honor requests received to the extent required by applicable law and within the time provided by law.

    Right to Access and Information Regarding Personal Information
    You have the right to request that we disclose to you the categories and specific pieces of personal information we have collected about you. Specifically, you have the right to request that we disclose the following to you, in each case in the twelve-month period preceding your request:

    • The categories of sources from which the personal information is collected;

    • Our business or commercial purpose for collecting or selling personal information;

    • The categories of third parties with whom we share personal information;

    • The specific pieces of information we have collected about you;

    • The categories of personal information about you, if any, that we have disclosed for monetary or other valuable consideration and the categories of third parties to which we have disclosed the information, by category or categories of personal information for each third party to which we disclosed the personal information; and

    We will deliver personal information that we are required by law to disclose to you in the manner required by law within 45 days after receipt of a verifiable request, unless we notify you that we require additional time to respond, in which case we will respond within such additional period of time required by law. We may deliver the personal information to you through your account, if you maintain an account with us, or electronically or by mail at your option. If electronically, then we will deliver the information in a portable and, to the extent technically feasible, in a readily usable format that allows you to transmit the information from one entity to another without hinderance.

    Right to Deletion of Personal Information

    You have the right to request that we delete Personal Information about you that we have collected from you.

    Right to Opt Out

    You have the right to opt out of the disclosure of personal information about you for monetary or other valuable consideration. To have your information removed / deleted, email remove@responsemedia.com with subject line “remove”.


    8.3.4.

    Right to No Discrimination
    We may not discriminate against you because of your exercise of any of the foregoing rights under the California Consumer Privacy Act, including by:
    • Denying you goods or services;

    • Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;

    • Providing you a different level or quality of goods or services; or

    • Suggesting that you will receive different price or rate for goods or service or at a different level or quality of goods or services.

    We may, however, charge different prices or rates, or provide a different level or quality of goods or services, if that difference is reasonably related to the value provided to us by your personal information.


    8.4.

    Data Sharing for Direct Marketing Purposes

    California Civil Code § 1798.83 further permits California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. If you are a California resident, you may ask us to refrain from sharing your personal information with certain of our affiliates and other third parties for their marketing purposes.     8.5.

    Do Not Track

    At this time, there is no worldwide uniform or consistent industry standard or definition for responding to, processing, or communicating Do Not Track signals. Thus, we are unable to respond to Do Not Track signals.

Will the Privacy Notice change?

We may change this Privacy Notice from time to time. We will not notify you of every change to this policy. Changes will be posted in this document so that you will always know what information we collect, how we might use the information, and to whom we may disclose it. Users of the Site should regularly consult the Privacy Notice posted on this Site for any changes.

Acceptance of Privacy Notice

This Privacy Notice is incorporated into and subject to the Terms of Service Agreement (the “Agreement”).
